PF and ESIC Registration for Employers

PF and ESIC registration employer guide India

PF (Provident Fund) and ESIC (Employees' State Insurance Corporation) are statutory social security schemes that benefit employees in India. As an employer, your obligation to register and contribute depends on your headcount and the nature of your business. Getting this right from the beginning saves significant penalties and protects your employees. Getting it wrong — even by oversight — can result in criminal liability.

This guide covers who must register, the contribution rates, the online registration process, monthly compliance requirements and the consequences of non-compliance.

Employees' Provident Fund (EPF): Applicability

Who Must Register

Any establishment (factory or "other establishment") employing 20 or more employees is mandatorily covered under the Employees' Provident Funds and Miscellaneous Provisions Act, 1952 (EPF & MP Act). Once covered, coverage continues even if employee strength later falls below 20.

Certain notified industries are covered from the first employee (e.g., specific classes of factories). The Central Government has also extended EPF coverage to additional classes of establishments by notification.

The 20-employee count includes:

  • Permanent and contractual employees
  • Employees on the rolls of a manpower agency deployed at your premises (in some interpretations)
  • Part-time employees

Contribution Rates

Component Employer Employee
EPF (Employee Provident Fund) 3.67% of basic+DA 12% of basic+DA
EPS (Employee Pension Scheme) 8.33% of basic+DA (up to ₹15,000) Nil
EDLI (Employee Deposit Linked Insurance) 0.5% of basic+DA Nil
EPF Admin Charges 0.5% of basic+DA Nil
Total Employer Contribution ~13% —
Total Employee Contribution — 12%

Note: The employee's 12% goes entirely to EPF. The employer's 12% is split — 8.33% goes to EPS (pension scheme) and 3.67% to EPF, plus the additional admin charges and EDLI contribution.

The statutory contribution ceiling is calculated on the first ₹15,000 of basic+DA. For employees with basic+DA above ₹15,000, the minimum statutory contribution is ₹1,800 (employer EPF+EPS) plus ₹1,800 (employee EPF). Employers may choose to contribute on actual wages, which benefits the employee's retirement corpus.

Employees' State Insurance (ESIC): Applicability

Who Must Register

Any establishment employing 10 or more employees (in specified states; in some states the threshold remains 20 for certain factories — check the applicable state notification) is covered under the Employees' State Insurance Act, 1948.

ESI coverage applies to employees whose monthly wages are ₹21,000 or below (₹25,000 for persons with disability). The wage ceiling is reviewed periodically by the government.

Contribution Rates

Contributor Rate
Employer 3.25% of gross wages
Employee 0.75% of gross wages
Total 4% of gross wages

For employees earning wages up to ₹176/day (approximately ₹4,137/month), the employee's share is fully borne by the employer (no deduction from the employee). The employer still pays its own 3.25%.

Benefits Under ESIC

ESIC-covered employees and their dependants are entitled to:

  • Medical benefit (OPD and hospitalisation at ESIC dispensaries and hospitals)
  • Sickness benefit (cash benefit during certified illness)
  • Maternity benefit for women employees
  • Disablement benefit for employment injury
  • Dependants' benefit in case of death due to employment injury

These benefits make ESIC a valuable social security net, particularly for lower-wage employees who may not have private health insurance.

Online Registration Process

PF Registration (EPFO)

PF registration is done online through the EPFO's Unified Shram Suvidha Portal (shramsuvidha.gov.in).

Documents required:

  • PAN of the establishment
  • Legal entity details (Certificate of Incorporation for companies, Partnership deed for firms)
  • Bank account details and cancelled cheque
  • Address proof of the establishment
  • Digital Signature of the authorised signatory
  • List of directors/partners/proprietor with PAN and Aadhaar
  • First payroll month details (employee count, wages)

After submission, the EPFO may conduct a physical inspection in some cases. Upon successful processing, a PF Code Number is allotted, which is used for all future filings and communications.

ESIC Registration (ESIC Portal)

ESIC registration is done on the ESIC portal (esic.gov.in).

Documents required:

  • Registration certificate or licence (Shops Act, Certificate of Incorporation)
  • PAN of the establishment
  • Bank account details
  • Address proof
  • Details of employees (names, wages, Aadhaar)

Upon registration, the establishment is allotted an Employer Code (a 17-digit number). Each employee is issued an Insurance Number after their data is submitted.

Monthly Compliance Requirements

PF Monthly Compliance

  • ECR (Electronic Challan cum Return): Upload monthly employee wages data through the EPFO employer portal by the 15th of the following month
  • Challan payment: PF contributions must be deposited by the 15th of the following month (for wages paid in the preceding month)
  • PF contributions paid after the due date attract interest at 12% per annum, and damages of 5–25% under Section 14B depending on the delay period

ESIC Monthly Compliance

  • ESI contribution filing: Upload monthly wage data and submit the contribution challan through the ESIC portal by the 15th of the following month
  • Half-yearly returns: File Form 6 (ESI Return) for each contribution period — April–September (due 12 November) and October–March (due 12 May)
  • Employee details (additions, exits, wage changes) must be updated on the ESIC portal promptly

Our payroll and PF/ESI compliance services handle the monthly filing calendar so you never miss a due date.

Annual Filing Requirements

PF Annual Returns

While monthly ECR effectively replaces the old annual return, employers must ensure that the Annual PF Accounts (Form 3A and Form 6A) are reflected accurately in the ECR filings for the year. Employees receive their updated passbook via the EPFO member portal.

ESIC — Insurance Cards and Pehchan Cards

Employees must be issued ESI Identity Cards (Pehchan Cards) through the ESIC portal. This card enables them to access ESIC medical facilities. Employers are responsible for ensuring enrolled employees receive and are able to use their Pehchan Cards.

Consequences of Non-Compliance

Under the EPF & MP Act

  • Interest on delayed deposit: 12% per annum (Section 7Q)
  • Damages for delay: 5% to 25% per annum of arrears depending on duration of default (Section 14B)
  • Prosecution: Willful failure to pay contributions is a criminal offence punishable with imprisonment up to 3 years and a fine

Under the ESI Act

  • Interest on delayed payment: 12% per annum
  • Penalty for non-compliance: Up to double the contribution amount
  • Prosecution: Failure to register or pay is a criminal offence under Section 85 of the ESI Act

It is worth noting that the EPFO and ESIC conduct inspections (including data-matching inspections using income tax and GST data) and are actively enforcing compliance, especially as digitalisation improves their ability to identify unregistered establishments.

Summary

PF registration is mandatory for establishments with 20 or more employees; ESIC for those with 10 or more employees (in most states). PF contributions total approximately 25% of basic+DA wages (employer + employee shares combined). ESIC contributions total 4% of gross wages. Both require monthly challan payments by the 15th of the following month. Non-compliance carries significant financial penalties and criminal liability. Timely registration and accurate monthly filing protect both the employer and the employees who depend on these benefits.

Frequently Asked Questions

Can a business voluntarily register for PF even if it has fewer than 20 employees?

Yes. Any employer with fewer than 20 employees can voluntarily cover their employees under EPF by applying to the EPFO Regional Office. Once voluntarily covered, the employer cannot withdraw coverage. Voluntary coverage is beneficial for employee retention and reflects positively on compliance culture.

What is the wage ceiling for PF contribution?

The EPF contribution is calculated on 'basic wages plus dearness allowance plus retaining allowance.' For employees with basic pay above ₹15,000 per month, the statutory contribution is calculated on ₹15,000 (i.e., employer and employee each contribute ₹1,800 per month at 12%). Employers and employees may agree to contribute on the full actual wages, which is often done for higher-salary employees.

What happens if an employer does not register for PF?

Non-compliance with the EPF & MP Act is a criminal offence. Employers face a penalty of 12–25% per annum on the outstanding dues under Section 14B, plus damages. The EPFO may also initiate prosecution, which can result in imprisonment of up to 3 years and a fine. There is no lower limit at which the EPFO ignores non-compliance.

Is ESIC applicable to employees earning above ₹21,000 per month?

No. ESIC coverage applies only to employees whose wages (basic + dearness allowance) are ₹21,000 per month or below (₹25,000 for persons with disability). Employees earning above this threshold are not covered under the ESI Act. Once an employee's wages rise above ₹21,000 mid-year, coverage continues until the end of the contribution period (October or March).

Can PF and ESIC be deducted on the same payslip?

Yes. For an employee who earns ₹21,000 or below and is employed by a company covered under both EPF and ESI, both deductions appear on the payslip. PF deduction is 12% of basic+DA (on the first ₹15,000 if basic exceeds that), and ESI employee deduction is 0.75% of gross wages. Both appear as separate line items.
